1 SCOPE

These general terms and conditions of sale (hereinafter referred to as "Terms") define the mutual rights and obligations in the event of the purchase of products or services on the Platform by a User (hereinafter referred to as "Client"). The Terms represent the entirety of the obligations of the parties. The Client is deemed to accept them without reservation, failing which their order will not be validated. Exceptions to the provisions of the Terms may be made only if they are the subject of a written agreement. These exceptions may consist of the modification, addition, or deletion of clauses to which they refer and will have no impact on the application of the other provisions of the Terms. The Seller reserves the right to occasionally modify the Terms. The modifications will be applicable as soon as they are posted online for any purchases made after that date.

2 ONLINE STORE

Through the Platform, the Seller offers the Client an online store displaying the products or services for sale, without the photographs having any contractual value. The products or services are described and presented as accurately as possible. However, in the event of errors or omissions in the presentation, the Seller's liability cannot be incurred as a result. The products and services are offered subject to their availability. Prices and taxes are specified in the online store.

3 PRICES

The Seller reserves the right to modify its prices at any time by publishing them online. Only the prices and applicable taxes indicated at the time of the order will apply, subject to availability on that date. Prices are indicated in euros and do not include any delivery charges, which are specified and billed additionally before the order is confirmed by the Client. The total amount of the order (all taxes included) and, if applicable, the delivery charges are indicated before the final validation of the order form.

4 ONLINE ORDER

The Client has the option to complete an order form online using an electronic form. By filling out the electronic form, the Client accepts the price and description of the products or services. In order for the order to be validated, the Client must accept the present General Terms and Conditions by clicking where indicated. The Client must provide a valid email address, billing information, and, if applicable, a valid delivery address. Any communication with the Seller can take place via this email address. Furthermore, the Client must choose the delivery method and confirm the payment method. The Seller reserves the right to block the Client’s order in case of non-payment, incorrect address, or any other issue with the Client’s account until the problem is resolved.

5 ORDER CONFIRMATION AND PAYMENT
The Seller remains the owner of the ordered items until full payment for the order is received.

a. Payment
The Client makes the payment at the time of the final validation of the order using the chosen payment method. This validation is considered a signature. The Client guarantees the Seller that they have the necessary authorizations to use the payment method and acknowledges that the information provided serves as proof of their consent to the sale and the obligation to pay the sums due for the order. The Seller has established a verification procedure for orders and payment methods to reasonably protect against any fraudulent use of a payment method, including requesting identification data from the Client. In the event of a refusal of payment authorization by credit card from accredited organizations or in case of non-payment, the Seller reserves the right to suspend or cancel the order and its delivery. The Seller also reserves the right to refuse an order from a Client who has not fully or partially paid for a previous order or with whom a payment dispute is ongoing.

b. Confirmation 
Upon receipt of the purchase validation along with payment, the Seller will send the Client a confirmation. The client who wishes to receive an invoice can request it by writing to me@federicafabbian.com In case of unavailability of a service or product, the Seller will inform the Client by email as soon as possible to either replace or cancel the order for that product, and potentially refund the corresponding price, while the rest of the order remains firm and definitive.

6 PROOF

Communications, orders, and payments between the Client and the Seller can be evidenced through computerized records, kept in the Seller's computer systems under reasonable security conditions. Order forms and invoices are archived on a reliable and durable medium, which is considered, in particular, as a means of proof.

7 DELIVERY

Delivery is made only after payment confirmation by the Seller's bank. Products are delivered to the address provided by the Client on the online form, which serves as the order form. Any additional charges resulting from incomplete or incorrect information provided by the Client will be billed to them. For availability reasons, an order may be subject to multiple deliveries to the Client.
Delivery is made, according to the method chosen by the Client, within the following timeframes:

Delivery in 7 - 15 business days.

Delivery times are given as an indication. No compensation can be claimed from the Seller or the carrier in case of delivery delays. However, if delivery times exceed thirty days from the order date, the sales contract may be terminated, and the Client refunded.

a. Order Verification
Upon receiving the products, the Client or the recipient must verify the condition of the delivered product or the conformity of the provided service. If one or more of the ordered products are missing or damaged, the Client or recipient must make the necessary reservations with the carrier at the time of delivery and immediately inform the Seller. The verification is considered completed once the Client or an authorized person has received the order without making any reservations. Any reservation not made according to the rules defined above and within the allotted time cannot be taken into account, and the Seller will be released from any responsibility towards the Client.

b. Delivery Error
In case of a delivery error or non-conformity of the products with the order form, the Client must inform the Seller within three business days following the delivery date. Any claim not made within the allotted time will not be considered, and the Seller will be released from any responsibility towards the Client.

c. Returns and Exchanges
The product to be exchanged or refunded must be returned to the Seller in its entirety and in its original packaging, according to the following procedure:

Any claim or return not made according to the rules defined above and within the allotted time will not be considered, and the Seller will be released from any responsibility towards the Client. Any product to be exchanged or refunded must be returned to the Seller in its entirety and in its original packaging. Return shipping costs are the responsibility of the Client.

8 RIGHT OF WITHDRAWAL

If the Client is a consumer, they may exercise their legal right of withdrawal within 14 working days following the delivery of the goods or the conclusion of the service contract. After communicating their decision to withdraw, the Client has 14 days to return or restore the goods. Any withdrawal not made according to the rules and timeframes defined in this article will not be taken into account, and the Seller will be released from any responsibility towards the Client. The Client may request a refund for the returned product without penalty, except for return shipping costs, which remain their responsibility. The return or exchange of the product will only be accepted for products that are complete, intact, and in their original condition, particularly with complete, intact packaging that is in a saleable state. The Seller must refund the Client the total amount paid, including delivery costs, within 14 days from the retrieval of the goods or from the transmission of proof of the shipment of these goods. If the order relates, in whole or in part, to digital content not provided on a tangible medium, the Client hereby agrees to waive their right of withdrawal for that digital content in order to receive it as quickly as possible.

10 FORCE MAJEURE

If the Seller is prevented, in whole or in part, from fulfilling the order due to an unforeseen circumstance beyond its control, this is referred to as force majeure. In the event of force majeure, the Seller is authorized to suspend the execution of the order, in whole or in part, for the entire duration of the force majeure. The Seller will immediately notify the Client. If the force majeure lasts for more than 90 days without interruption, either party to the contract shall have the right to unilaterally terminate the contract by sending a registered letter to the other party. The services already performed by the Seller will, however, be invoiced to the Client proportionately.

11 INDEPENDENCE OF CLAUSES

The illegality or total or partial nullity of a provision of these General Terms and Conditions shall not affect the validity and application of the other provisions. The Seller reserves the right to replace the illegal or null provision with another valid provision of similar scope.

12 APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are governed by Belgian law. In the event of a dispute and failing an amicable agreement, the dispute shall be brought before the courts of the judicial district of the Seller's registered office.
